Im in an abusive relationship, very controlling, i live in wisconsin and want to move to california. If i move with my baby will i get arrested? There is no court order in affect and we are not married. What if he was in jail or prison, he has 5 dui and is on probation?

no court order, not married. i need to know for surs i wont get arrested. He is on my sons birth certificate, deoesnt mena he is a father, we all live together but he only spends maybe 30 min a week eith him. cant call d.a. he knows the d.a. dont want to get caught that would be really bad for me.

Sweety, as long as there is no court order for you NOT to leave the state or for you NOT to remove YOUR baby from the state, YOU have a right to go where ever it is your heart and feet can lead you!!

Sounds like moving would be good for you. And hopefully once moved and settled, you will beable to find it in your heart to start picking better men!!

You don't have to be married to have a problem. Has the man be declared the legal father of your child? If so you will have a problem. What you need to do is get an attorney. If he is abusive to you, report it to the Police. Have him arrested. Then get a restraining order and apply for full custody of the child. Then you can move.

Check the law online, but I think you are okay if you are not married. I live in a state and want to move away with my kids to another state, but I am married and the law says I can't.

In most states you could leave has long has there is not order telling you not to and has long has he doesn't have sole custody. If you don't have any sort of custody arrangement I don't think he can do anything. Call your local District Attorney's office and ask them. Or if you have a legal aid office they sould be happy to answer your question and it doesn't cost anything to ask.

Well Kandi: From what you say, your not married, then he has no claims on you. How about you son? Does he have an actual court claim that your son is his and you have to keep him in Wis.?
If not Honey and you have another chance in California.? Pack your bags, don't tell anyone where your going and good luck.

It varies from state to state....but as far as I know it is. You will have to get his a letter from him stating he is allowing you to leave the state. For your question I doubt he will do that for you. I would go to court and ask them to allow you to leave the state. If you leave with your son without letting him know some states consider that kidknapping._
