Not the proper way of handling the situation , try divorce first as you may be open to a federal charge for taking the kid across state lines . The father has rights also in spite of your differences.

If you are married in one state and move to another, you are still married to that person. Moving to another state does not erase your marriage vows. If the woman moves in with another man while still married she is committing adultery and that does not look good to the court system. If a woman is not happy with her husband, she should first try some marital counseling with or without her husband. For the sake of the baby, she should try to reconcile her marriage until both are sure there is no hope for the relationship. Unhappiness is sometimes able to be worked through with help from a professional.

You cannot leave the state and forget about your husband - especially if he wants custody. This is a legal matter that must be resolved legally (in a court of law if necessary) - otherwise you may be breaking the law and could go to jail or even lose custody of your children. Talk to a lawyer if you want to dissolve your marriage. Running to another state will not make him go away.

You can but if your husband files first he has grounds on abdonment and could challenge you for child custody, i which you will have to return to your former state to face divorce court. You will probably have to return since you dont meet residency requirements in the new one. Chances are you will get child custody, etc. but will have to get written permission from your husband to move the baby. Sort of a catch-22 situation but the choice is yours. Good luck

you can't cross state lines even for a visit with another mans baby unless you have his permission otherwise it's considered kidnapping. you can't move across state lines with another mans baby unless you have the permission of the courts who did you custody hearing. If dad says no though it's usually a nogo.

She can take the baby, but her husband can get a court order preventing her to do so, and if they do have a custody battle, it probably would look rather bad on her part.
