can they place me in collections. do they also have the right to have a third party remove over payment of wages from my bank account

to add to this situation trhe employer is wachovia and they claim they over paid me some $300. i then discovered that a third party company called hewitt and associates too those funds out of my account. I have since discovered that hewitt and associates are an outsourcing company for human resources. i dont ever recall giving my ex employer permission to give out my confidential info to any one else let alone for them to have access to my bank account to take funds out of it

First they have to take you to court. Then yes, yes and yes.

They can of course put the alleged amount on collection. Whether it is actually owed has nothing to do with a collection agency. Without a court order there can be no seizure of a bank account of garnishment of wages as this requires a judges order after a court appearance you you and your employer.

The only claim they have is to a small claims court.they will only do that if the amount is substantial.they have no right to invade your bank account unless a court approves it.if they try to place this on collections you have to challenge it in writing and at the least write an explanation called an addendum to be attached to your credit report.
