Actually yes, my birth mother died 9 years ago. the children of the birth mother have a right to her but she doesn't have a right to them if that makes sense. I was not interested in her estate when she passed. Her father had died of asbestos cancer. Members of that family called me to tell me they couldn't get the rest of their money until her estate had been probated meaning we had to lay claim to her portion. My statement that her part should go to her mother fell on deaf ears. As a result, I spent 2500 to probate her non existant estate to get 1/8th of her portion of her father's settlement (there were 8 of us kids) I got a check for $250.00 and every so often a miniscule check for a dollar or so. The lawyer at the time said to me "the children have a right to the mother but the mother doesn't have the right to the kids" so the answer is that yes, an adopted child does have a legal right to the birth mother's estate at least in texas.
