It is settled constitutional law (settled by the US Supreme Court) that everybody within the United States has constitutional rights (such as the right to a Miranda warning; the right to Gideon legal counsel; etc.) and that US citizens have such rights everywhere in the world.

But Constitutional rights are essentially those of legal fairness. They do not go very far. For example, in Alvarez-Machain, the Supreme Court said an alien who is abducted and brought to the US for trial (he was, by the way, later acquitted by a jury) had no cause for complaint.

And George W. Bush's administration has diminished or denied such rights to "unlawful combatants": it remains to be seen what the Court does about that.

Certainly an "illegal immigrant" on US soil has the right to have his or her claim to citizenship or legal status heard by a court. Imagine a Texas Kickapoo Indian or a Tohono O'odham (these are cross-border tribes) not having the right to have his or her status determined. Or someone born in Mexico to a US citizen. The latter is this case: http://uniset.ca/other/cs6/571FSupp218.html (birth in Mexico to a US Citizen, a Puerto Rican military deserter).

Any foreigner accused of a crime has the right (by treaty) to consular assistance. The USA ignored, in some early cases, the International Court of Justice's order that the execution of a foreigner who had not been given such assistance (advice and counsel by his country's consul) should have a temporary stay of execution.

If the US ignores international law, it cannot complain when US citizens are denied such rights. Or US soldiers tortured, etc. That was Sen. John McCain's concern.

why do you call us haters.. are you not familiar with our laws.
If not, don't you think it is time you and the others became familiar with them. Look them up for yourself, please.
There is NO issue with those that come here legally, only with those that have broken our laws just by merely entering this country ILLEGALLY.
Now, do I hate these people.. not at all. Sometimes, the law isn't about what's in my heart, but by what's in the books. Imagine if the judges and other law upholders decided to turn (more of) a blind eye.
We have enough of our own to care for, we need to know who is coming into this country, what medical background, criminal background, etc. Why don't you enter another country illegally and find out what they do.
Shame on you!!!

I see that you don't have any brains to ask such a question as this and then not be receptive to the answers that you get. You obviously asked this question hoping for a certain response - in support of rights for illegal immigrants. However, you cannot accept the truth of the answers that you received. You asked, "OK, let's see your side." Then, when you got answers that you didn't agree with, you said "later." You got a RESOUNDING "NO" to your question, but you couldn't accept that. You are pitiful.

Other than human rights, they shouldn't have any of our constitutional rights.

What human rights? Well, food, water, first aid, and a bilingual interview to see if they meet asylum standards. Then a bus ride across the border. If they meet asylum standards, then a hearing on the matter followed with the appropriate action.

The right to be deported back to their country of origin with respect. The right to emergency medical care if needed. Food and drink during their process of deportation.

It's funny that everyone is bringing up the "cost" of illegal immigrants. Do you not realize who they are? The person who builds your house, the person who cleans the toilets in your office building, the nanny, the maid...they do the jobs that we as Americans take for granted. Who is going to do them if they don't?

I am a born and raised American. But my husband WAS an illegal immigrant. As well as his family. They came here so they can have a better life. They paid taxes, worked the jobs that no one wanted...and eventually EARNED their citizenships. What did we do but be born here...they actually risked their lives and worked until their hands blead-just be an American.

So the next time you want to throw someone out of the freest country in the world you might want to get to know the person. They just might be the most amazing person you've ever met.

Yes~ they have the right to remain silent, and they have the right to fight in their countries of origin for a better place for them to live.
Why do they come here if it is so horrible?.
