On average a pot has sides that are situated 90 degrees parallel from the bottom and a height of roughly 1/2 the the diameter of the base, usually accepting of a cover or lid.
A Pan's sides can have variable heights , some with straight 90 degree sides and others with a concave radius depending on the intended purpose.

A pan is the flat one, used for frying stuff. A pot is typically smaller, and taller, used for regular cooking, or boiling water, maybe mac and cheese.
