i am dating a man who happens to be a soldier in the army. if we were to get married and he had to relocate would the army take into consideration that my divorce papers prevent me from leaving the state since i have a 3 year old child with my ex husband?

NO -- Orders are orders. We can request certain duty stations, but when the orders come down, we, the servicemembers, do realize that we serve to meet the needs of the service, and not the other way around.
IF you do marry him, then you need to prepare to go back to court and get YOUR divorce orders and custody orders modified yourself. That is your responsibility.

Here's how it will happen:
The army would send him wherever they need him. Depending on whether or not it is cheaper, they'll give him BAH based on where he is stationed. Now, since it's your choice not to go, they won't give him separation pay.

No. To put it point-blank, the Army only cares that he goes to his next duty station. They don't care whether you go or not.
