and begged me not to call the cops when i got home i found out he gave me a wrong number and called him he told me he will pay for all the damages for my car. actually it was his girl friend that called and left several voice mails on my phone telling me she will pay for it and even signed a note. now she is telling me she wont pay for it since her boyfriend is now in jail. what should i do??

If you didn't report the accident to the police when it happened then you'll have to sue the vehicles owner in court. Most police departments will not do a report after the fact or after you've agreed to settle it on your own. Save all the documentation you have. You can fight it on your own, though a lawyer or contact your own insurance company. Your insurance company will use their own resources to get the other party to pay so they don't have to. The downside to that is they will consider it to be a claim and probably adjust your rates. For future reference, if you are positive you were not at fault it is always better to get a police report done. You may be able to settle things between yourselves in which case the police report won't go anywhere but at least you'll have it if things go bad, as it appears they have for you. And by the way, the owner of the car is responsible for the damage not the driver. Good luck.

Take photos of the front of your car - license plate and vehicle identification number (its on the plate on the dash or on a sticker on the side of the door). Then put those in a safe place and hold on to them. I'd keep them for at least 3 years. Since you gave the guy your insurance information - he will call in a claim if he thinks he has damage. In the mean time - don't sweat it. If you get a call from your insurance company that means that he filed a claim and you will need to make sure that you cooperate with your company in the investigation of the incident. You may want to check with your agent and make sure that your account shows the correct phone numbers and address. You can also let your agent know what happened and see what they suggest. Lots of folks have little fender benders where there is no damage and don't file claims. I had one when I was a teenager myself.

You need to take them to court and notify your insurance Company, that this person was an uninsured motorist. If you have coverage for uninsured motorists, you be OK you always have the call Police when there is an accident it is for your own protection and you need a Police Report for the Insurance Companies. This is a common trick by uninsured motorists to keep the other person from calling Police, they come up with all sorts of sob stories. don't fall for any of it. You need to file a report against him for fraud at the Police department, it is a criminal offense giving false information like he did.

As long as you have his license number and address, you are ok. I would report it to the police ASAP, and you own insurance company.
