got a summons from my courthouse today .. says that i'm being sued for a credit card debit from 5 years ago . it has no court date it says i have 21 days to i guess file back . does this mean it too late to maybe call the people i owe and set up payments. ?? any help will do ,~~~~~~~~~~~~~~scared :(

No, phone them and set up a payment plan. They will try to work with you and avoid going to Court. It costs them money to go to Court. Or you can contact a local Credit Counselling company in your area. They can also help you set this up.

In many states, once you get the court summons you MUST file an answer to the complaint. If you don't, the creditor will get a default judgement.

Call or contact the court if you are not sure of the procedure. THIS IS VERY IMPORTANT!

And yes, you can contact the creditor and try to negotiate a settlement. Remember, however, he may not be very receptive about talking to you. He just had to go through the trouble and cost of filing a lawsuit against you, and he's not likely to ignore those costs.

When you go to court, the judge will give you a chance to settle out of court, that means you and the party will have a chance to go into a little room and make reasonable, but affordable monthly payments to them. Just make sure you keep your obligation, or you'll wind up back in court. Good luck!

If you already got a summons, that means it's too late to call the party...MAKE SURE you go to court, if not, they will issue a bench warrant!

Worst advice would be to tell you to call the collector and set up a repayment plan. Collectors love that because they don't cancel the lawsuit and next thing you know they have a default judgment and they are towing away your car.

When you are served with a lawsuit you need to respond to the lawsuit by filing an answer and showing up in court.

Call them and see if you can pay in full or if you can set up a payment plan. If they agree, don't be late by even one day or they will take you back to court. By discussing this with them and by making payments, you will be lengthening you statute of limitations so be careful, and due what you say you are going to.
