I have to take a pre-employment drug test. Part of the drug screen includes opiates. I have a bulging disc in my neck which i have been prescribed Tylenol 3 with codeine. Can i legally fail the drug test if i am taking a legal prescription drug with valid prescription.

As long as you are up front with the drug screener and your potential future employer, you should be fine. Most times when they do a drug screen they are looking for illegal substances. Yes, The tylenol 3 will likely show up, but it should be assumed that you are takling for medical reasons.

Of course they can do that, regardless of when the results come back. That's the whole POINT of the drug test, to fire you if you fail it. He still may not fire you if you are a good employee and are never under the influence of TCH on the job, but he is completely within his legal rights as an employer to do so and you would have zero legal recourse to protest.

Well, codeine is going to show up in the toxicology report, as long as you bring your prescription to the test and list it before you turn it in you'll be okay, but it has to be prescribed by a physician to you, and it has to be taken in the dosages recommended by the doctor....

possibly, so to be safe take along your prescription to the drug screening. Also let them know of any over the counter drugs you are taking.

Yes you will fail the drug test, meaning the drug will show up in your urine. But if you have a prescription and you show it to them you will fine.

Hmm, i'm pretty sure that it will show up.
Just let them know ahead of time, and show them a copy of your prescription, and you should be fine.
