If you arrive there at the same time you have two answers.
1. who can saftely turn. If you have oncoming traffic blocking you then he goes.
2. Right of Way. The driver turning to the right would have the legal passage if an accident were to transpire.

He's making a right turn and doesn't have to cross traffic so he has the right away, unless you got there first then you should have the right of way. (not that it works out that way)
