The tomato is, botanically speaking, the fruit of the vine. But, from a culinary point of view, it is nearly always grouped with vegetables. Interestingly, the United States Supreme Court ruled on this issue in 1893. The verdict? For the purpose of levying a tariff, the court classified the tomato as a vegetable.

No they are a fruit. A long, long time ago our greedy government had a special tax on vegetables but not fruits. And somebody noticed that tomatoes were very popular. And being a fruit were being sold and shipped without being taxed. So Congress passed a law legally classifying tomatoes a vegetable so they could be taxed.

Tomatoes are a fruit.

Vegetables are basically an edible part of a plant.

Fruits are the seed producing part of a plant.

Tomatoes are fruits... but qualify as vegetables as well. Weird, huh?
