No they are a fruit. A long, long time ago our greedy government had a special tax on vegetables but not fruits. And somebody noticed that tomatoes were very popular. And being a fruit were being sold and shipped without being taxed. So Congress passed a law legally classifying tomatoes a vegetable so they could be taxed.
