This would be the third year this boss has done this. Shouldn't he have to give us our paychecks before the holiday begins? We are in California.

Does your company calculate and print the paychecks themselves, or do they send the work out to a company like ADP to print up paychecks?

If your boss sends out the payroll work, that could account a delay happening the week AFTER the holiday...since the payroll company is doing the same amount of work in a shorter amount of time. But in your case, the calculations and printing would have happened long before the holiday.

When are the paychecks physically in the building? If you have to wait for them to be sent in from an outside company, it might be out of your boss's hands.

If he actually has them in his hands before the holiday, he's probably just being a prick. Check your company's policy about that. Most medium-to-large companies have written guidelines on how holidays affect pay schedules.

If the company handbook is on your side, and your boss has the actual checks in plenty of time, take your concerns politely and calmly to the HR department, and if that doesn't work call your local labor board. Just because he's a boss, doesn't mean he has the right to play God with your pay.

Yes he is allowed to do that....it sucks and is not right but that is the way some places do.....it's all about keeping the money another day in thier account to collect the interest off of your paycheck. And there is nothing you can do about it. Sorry.

Normally if payday is a holiday than you are paid the day before. Not sure if it is legal or not to hold checks.

yes he must give them to you on the day of normal payday or the day before....he could call you all in and give them to you on the day you are off but why would you want to do that?...if he gives them to you after 2:00 p.m. on the day before they should not hit his bank until that following monday anyway
