2 months ago my mom recieved a dunning letter from NCO. I told her that the next step was to send a DV and CD letter certified mail. Ok it was sent out a month in a half ago. They continued to call her cell phone daily with a recorded message even after her green card came back.

The calls stop for a week or so until they reached her on her job today asking for a payment. She didnt know the law so she gave them her bank account information and told them to take out $500 on the 19th. keep in mind now the debt is for over $800. Then they told her that they will take all the negatives off her credit report dealing with that account orally not in writing! I see her credit report everyday and NCO isnt on there nothing but Cap1 charge off they are trying to collect on.

I told her it was illegal for them to keep trying to collect on a debt that they failed to validate within 30 days, which they still havent done so now. She would like to know if it is anything she could do to stop NCO now?

Call the bank and cancel the draft. It she is unable to, cancel the account.

NCO will take the full amount and then some.

Will will NOT delete the negative info!

Even if you had it in writing, they say they will then do not follow through.


Seen it a thousand times.

The debt validation was recorded and the agreement was verbal.

There should be no recourse from NCO other then future harassment.

If that is an issue send a cease and desist or change your mothers phone number....

Dont take their word, they will screw you everytime.

Your mom definitely has a reason to file suit against the agency if the cease and desist letter was signed for by the same agency who continued to contact her. Does she have proof of these contacts? Does her phone bill show the phone number of the agency calling after the certified green cards' date? Look up the laws regarding collection agencies and consumers under FDCPA, (Federal Debt Collections Practices Act). These laws are designed to protect consumers' rights against unfair practices of collection agencies. There is certainly a good chance your mom will receive some monetary damages and her debt will be paid or absorbed by the agency if they are found at fault of breaking the law. Good luck!

OK, well it looks like you can sue them.
you have the slip of them receiving the documents. And if you have proff of them calling in phone records and recordings. get a consumer rights attorney or a public attorney to see what you can do. It looks like they violated the law, and that could be 1k in damages payable to you. Go speak to a lawyer, it could cost you nothing. Start calling around. NCO is known for unethical practices.

NCO is bad news they never take you off the credit beareu even after you pay you just need to contact the credit beareu and send them proof to take you off.

It is incredibly difficult to prove oral agreements. Any and all arrangements through a collection agency must be in writing. Think of collectors similar to a used car salesman. They will promise you the world until you actually purchase the car.
