The only thing they can keep in an arrest is illegal items and your drivers lic. They can only keep your lic if you were arrested for dwi, your lic. is suspend or revoked, or you have an outstanding fine or warrant you have to pay for. Other than that they should give everything else back. My advise is to get a lawyer.

If you were released, you should get your personal belongings back.

If you are charged with a crime, you should have an attorney who can address that issue. If you are not charged with a crime, then simply politely inform the police clerk that you never received your personal property back after being arrested.

Yes they should give you all your personal belongings back. The Police Dept. that i work for puts everything into a paper bag and that bag is released to the prisoner upon release. They only keep evidence and illegal goods.

Go back to the station, let them know what happened, and you should be able to get your things back.
