I am a prelaw student and I was once told by a judge that if you think you may fail a breathalyzer or field sobriety test don't take the test. The problem with this though is in some states if you refuse to be tested it is an automatic 3 month suspension of your license and a night in jail but it is also an automatic suspension of your license if you are drunk and it is a lot longer than 3 months. The upside is when you go to court (hire a lawyer first) the state will have no evidence to prove you absolutely where legally drunk and a decent lawyer should be able to get the DUI dropped and it won't be on your record.

If your caught behind the wheel forget about it. If you are being chased or are in an accident RUN LIKE HELL! If they don't find you behind the wheel there is no proof. Of course get a lawyer Quick. When the cops come to ask Questions, hand them your lawyers card & say call my lawyer. This is very important. They will make all kinds of threats to try & get you to admit to driving, but the only thing you should say is call my lawyer, nothing else. Of course if you did any property damage you still might be held liable to pay that if the car was in your name. Also, This won't work if there where any witnesses that saw you get out of the car after you wrecked or whatever. The best way to get out of a dui though is don't be stupid enough to drink & drive. Dumbass!

If you refuse the test in the state where I live, you are automatically guilty of OUI by default.
And, when you get to court, don't expect to get a lessor charge, even if you hire a lawyer.
All of the people I know who have been stopped while drunk are now begging rides with their friends or walking - or brain dead if they continue to drive - a second offense is automatic jail time and a very large fine, usually $800 or more - and don't look for your license for at least a year or two, and then only after another hearing and even more bureaucratic red tape.
When a person drinks and then drives - how absolutely dumb is that?
There are a lot of people in jail trying to rationalize why their buddy or girlfriend or some other innocent person or family is dead - all because of their single, stupid, totally unnecessary act.

No I haven't. I could never drive because I would get sick from the movement of the car. I'm talkin yackin it so bad I just could not drive.
I know a few people that got their DUIs reduced to a lesser charge but none in a very long time. The courts now are very hard on most people when it comes to dirnking & driving.

Never got one personally. But a friend of mine did and she got a lawyer. The lawyer got it reduced to a 'wet reckless' which is similar to a dui, but no jail time. She paid a fine and was on probation. Assuming you didn't get arrested for an extreme dui.

Never took a Breathalyzer, but was tested....
It always helps to be extremely nice and courteous to Mr/ Mrs Leo. Don't give them a hard time.
Always tell the truth of the circumstances, and if it means to apologize for " doing something wrong"...apologize.
You are the one who is "caught" and they are the ones in "the power" at that time......
I once apologized to a State Trooper for speeding over 15 pass the limit. The officer wrote a ticket , but could have made it worse if she wanted it too, I could have paid a much higher fine.
Leo's are actually sometimes the nice people in uniforms. You give them a hard time, they will give you a hard time.
Aside from that , If you are going to drink, KNOW your limit !! find a place to stay overnight ,take a cab, or drink at home. Don't get in a car and Drive Drunk.!!

yes! They violated my constutional rights and it was thrown out before it ever went to court!
Kymbo, you lose your license for 3 months in my state whether they find you guity or not
DMV has a Kangaroo court and everyone is found probablr cause to yank their license Mine was dimissed on Constitutional grounds and I still lost it for 90 days!

If the accusation is fabricated, deny the charge. It the charge was actually committed, admit it and but make it as a mitigating circumstance.

yes, by God's grace or something crazy. I was so drunk even I noticed I was swerving. Haven't driven drunk since, for my sake as well as everyone elses.
