Our baby is teething, and has a temperature of 101. The teething has been going on for weeks now. We have taken her to the doctors and they said she is fine and that the temperature is due to the teething, and she is not sick or contagious with anything. We even got a not from the doctor to give to daycare. But the daycare refuses to babysit her because they say its the law that if they have a temperature over 100 they cant babysit them. I have never heard of this. And, they still make us pay for the days that they refuse to babysit her. We live in a very very very small town in the state of Missouri, and there are no other daycares. Her doctor specifically wrote a note to the daycare saying she was fine, but they still refuse to watch her. And can they really make us pay for days that she is not there?
We have asked them to take measures to reduce the temperature before they call us to pick her up, and they wont even do that.

well by law they cant watch your baby with that temperture even if the child isnt sick. It is just to cover their butts incase something does go wrong with the child. But as for them charging you they can't do that cause the child isnt present, unless that is the only way they can guarantee your child will have a spot in their daycare. I am also from a small town in missouri and have a niece in daycare and they still charged my brother if she didnt go a day or two, so she wouldnt loose her spot. You may ask the doctor if you could give your child anything to make the fever go down.

It's precaution. While the doctor may say it's nothing, the daycare is responsible for numerous kids. If those kids get sick from your kid, despite the note from the doctor, they are liable.
Basically they are being extra careful with your daughter. A fever is a fever, and it could easily turn into something serious, despite just teething. Our pediatrician always told us that teething won't cause cold symptoms or a fever; those are unrelated to the teething purpose.
They can't make you pay for the days you don't go there, unless you are obligated to take her there 3 times a week.

This is not just a state law, but a Govenmental law for all day-cares. And about paying... yes it is not right but that is their choice. Some day cares will let ppl slide on this. Maybe find a person who watches children in their home temporarily while she is teething. And sorry to say this but usually teething DOES NOT cause a temperature even though your doc claims this. It is the openness in the gums that causes jerms to get in your babies system and her immune system's fighting them by running a temp... Little trick. GIVE HER MOTRIN THAT LASTS 8 HOURS EVERY MORNING 30 MINUTES BEFORE CARRYING HER TO DAY CARE! This will solve the problem hopefully... and look for a new loving day care maybe.

I am a pre-k teacher and in our school if the child has a temperature over 100 yes we must call someone to pick them up immediately and they have to be removed from the other children till they are picked and they are not to return until the fever is gone we check them when they come back and if not under 100 they are not accepted back. Sorry but this is the rule.

check with the contract you have with the daycare. Most daycares won't accept them with a fever It's not a law in ohio where i live that i know of, but it may be where you are at. I know they would have to seperate her. And yes they can charge you even if she is not there, they are holding her spot.
As far as the fever, I am not convinced it is from teething. I believe that is one of the old wives tales that was recently proved untrue. Maybe want to check with another doctor.

I slept on the settee the completed time and became so grateful to her. yet I actually would desire to extremely pass because of the fact of a fever, if I only had a cold and did no longer experience as much as working and/or passing alongside my chilly germs i'd only shop her with me.

Yes they have to be sent home when its that high. Most parents want to be with there kids when they have a high fever even if the doctor says there fine!!

Its probably true, they are responsible for a lot of kids, whether the doctor says your babys alright or not. But they shouldnt make you pay for the days.

With the doctors note it shouldn't be a problem but i would ask a lawyer they could give you the best answer.
