You will need to find a lawyer to help. Because she died intestate, an executor will have to be appointed. Your lawyer may be able to have one of you (or all of you) appointed as the executor of the estate.

The executor(s) will have to use the assets of her estate to pay off her debts. The executor(s) may have to sell off her property to do that. Whatever if left will be distributed to her heirs in accordance with the laws of your state.

The executor(s) will have to present the probate court with a detailed record of all transactions and attest that all debts have been paid and the heirs paid.

Lastly, the executor(s) will have to file the final tax return.

I hope this helps you.

No living will at all?

Just went through this but there was a will.
First of all get a credit check on your sister. Make sure you have her social security#, Driver's License, 4 Copies of Death Certificates on hand. Make sure she has no oustanding debts to creditors, mortgage, gambling winnings or so forth. Does she have a husband? If not, find out in whose name is her home in. Check the deed on her home, or call a Title Company to get you a copy of the deed. Did she have a p.o. box? A Safe deposit box at bank. YOu need the key to that if she left one. Also life insurance policy from work or stocks or bonds important.

I am terribly sorry about you loss, I believe that it is forfeited to the closest remaining relative, so that would be your father. Your father can then distribute the bills, property, etc. Good luck, and again sorry about what happened.

WHY DOES THIS FALL ON YOU?? I WOULD MAKE SURE EVERYONE DID THEIR PART OF THIS DEPRESSING JOB. JUST MAKE SURE YOU HAVE
CERTIFIED DEATH CERTIFICATES (NOT COPIES) TO GIVE TO ALL PARTIES AND THAT SHOULD BE THAT.
