She went to daycare once this week and that night she told me that the daycare providers son had touched her vagina, I took her to the doctor the next morning, and called the daycare house to tell them we would not be coming back because she had accused her son of inappropriately touching her, and that in her doctors professional opinion something did happen. Her story has been consistent throughout. The daycare is insisting we pay for the week even though we were only there for one day and her son allegedly hurt our daughter. I am of the opinion that it was two kids the same age experimenting, but regardless i am not bringing her back, there was obviously a lack of supervision going on. They are angry at me for taking her to the doctor as they are now going to be reported to the state. I am having a hard time being angry at all due to the fact that it was a child, and who knows who even instigated the situation. I don;t know how to make her back off.....

if anything it should be me in her face about the situation. i have offered to pay her 20 dollars for the day, but she insists on the whole weeks fee, I have refused to pay her that amount, but she won;t leave it alone. What else can I do?

they are being reported to the states common entry point, the state will decide whether or not to pursue the matter, I am a mandated reporter as well and have reported it to everybody i can, but all I can personally do at this point is not take her back.

You don't mention the age group here, if they are very young and just experimenting with body parts I doubt that the daycare will be reported.

This can happen in your own house while children come over to play, however, I don't blame you for not wanting to have your child there any longer as you have lost the what you thought was a trusting environment and a safe environment. However you did have a contract with the lady, you will have to show that you did report this and the doctor concurred, also you will have to show that you paid for your child's daycare somewhere else.

You can try blocking her phone number from your home phone or tell her to stop harassing you over this. Tell her that you are willing to pursue more invasive measures if need be, such as investigating if this has occured between her child and other children placed int he daycare and so on. You have a right, although check if you have signed a contract and what it states regarding leaving if you are legally bound then you may after all have to pay the remainder of the week.

I'm sorry you've had to deal with the problem. Honestly, I wouldn't worry about you owing her money. Boviously, if you take it to court it will be come public information, the judge will ask why you wont pay and why you took your daughter out of that daycare in the first place. If she REALLY wants everyone to know (she doesn't) then she'll take you to court for the money.

As far as the children go, yes children are curious but for two three year olds to be left unattended long enough for a doctor to be able to tell she was touched is ludacris! The woman is being really stupid about demanding money.

If it were my child, I wouldn't be mad at the other child either but I would be furious with the adults in the situation and take all actions possible to make sure it doesn't happen again. It's your right to protect your child and keep other children from harm. The other three year old is on a slippery slope unless the situation is handled properly. If he doesn't know what he did was inappropriate, it will only happne again to someone else.

I'm sure the situation was nothing more than the children experimenting, they get curious about those areas. But certainly it should NOT have happened with proper supervision. You are correct in taking your daughter out of the daycare and should not owe them a dime. I agree with some of the others, threaten with a lawsuit (neglegence, abuse, etc.). She should back down after that. It's so hard to find a good day care, I just hope I can stay home with my children, at least until they're in school.

Write the better business bureau AND contact your states attorney general.

If you go to bbbonline.com or something like that you will be linked with a way to contact them.

If you do a search on 'yourstate' attorney general, you will come up with a link to go to that site. Search for contact info

Send both the same letter and let the one know the other was sent the same letter. Also send a copy of each to the daycare.

Make sure you back up everything with any proof you have. Bill from the dr visit, bill from the day she was in daycare, etc...

You took your daughter to the doctor, now take the information to the police! I don't think they will be trying to get anymore $ from you. Even though it was a child that touched her, the daycare is responsible. Stand your ground, and take care of yourself and your little girl. It's wonderful she has a parent that stands up for her. Take her to small claims court. Even if it is only over $20! I find it hard to believe that she is getting mad at you over something that her son did. And if there is a way to notify other parents of the things that have happened to your kid, I'd do that as well. Maybe contact local news stations, who may (probably not though) run a piece about unsafe childcare facilities!

contact a lawyer right away if she is has insisted more than once that you pay her for the whole week. sounds like she has consulted and is following a lawyers advice to get you to pay. seems like she would be more than willing to forget the week's pay, under the circumstances. this sounds like she is following an attorney's advice. at the very least you should talk to an attorney about this situation and what your legal requirements for payment would be. until then, i would not pay her. get an attorney's advice. paying just might indicate that you do not take this accusation seriously and it is very serious.

Your child did not receive the supervision that you were promised. You owe this woman nothing, because she did not provide the service that she said she would provide. Next time she calls, tell her to take you to small claims court. A judge will sort this out -- and find in your favor.

If it were my daughter I'd be doing alittle more than just not taking her back. Maybe it was harmless curiosity but you never know. I would go down there and tell them what happened. Depending on how old the little boy is he had to have learned it from somewhere you know what I mean. Plus, they need to know that it's not acceptable and they will face the consequences for not properly watching your child.

What does your contract with her say? If it says you pay for the whole week even if you don't go then you are pretty much legal stuck paying for it. If there was no such agreement I would tell her I wasnt paying it and leave it at that. I am glad you reported it. She needs her daycare license jerked away, there is NO excuse for what happened to your daughter. Is your daughter going to seek counseling? I am sure her doctor told you exactly what to do about that. I hope her son gets some counseling help too Poor daughter.
