Yes, but it will be a little more difficult for him and it will be consuming both financially and time wise for him.

He will have to establish paternity which he'll have to pay for (these are expensive) then he'll have to hire a lawyer to take you to court to get visitation and or custody.

The father shouldn't get full custody unless the mother is found unfit.

My friend nursed her baby which made it impossible for the father to have over night visitation until the child was about 1.

When you have the baby..at the Hospital they have you fill out papers asking who the Mother and Father are...If you did not put the Fathers name down...and he later wants custody..He has to get a Paternity test done to prove he is the Father...If you already have had the baby and did put his name down..and he signed it...Paternity has been established...and when you go to court his Attorney will have the copy that you both signed at the Hospital...Now for a Father to get custody..They have to prove the Mother is unfit...And that is VERY HARD!...I worked in the courts for awhile..and by a Dad coming in saying slander things about the Mother does not work!...You have to be on Drugs..alcoholic...have proof that you do this...and It is next to impossible to prove..unless you are in really bad shape and your family and friends testify against you....Or there is a record of you neglecting the child or hurting him/her...Hope this helps! One word of advice!..EVERY guy (almost) always threatens the Mother to take the child when they split up!..Mine did...he just said it to scare me and piss me off!
Sorry to ramble!..But if he gets the test done or you have not had the baby and are deciding what to do...He gets rights..and that is all...something you both need to get attorneys on..or work something out and tell the judge...but if he has not been paying for the child since he/she has been born..you will get back child support for the whole time...

I didn't put my fiance's name on our daughter's birth certificate for alot of personal reasons that I would rather not share. However I am here to answer your question, he could request and pay for a DNA test that will prove whether he is or is not the father and the courts will decide from that! These days though it is almost impossible for a dad to get custody of the child..They really need to prove the mother is unfit and crazy!!

Absolutely. He needs to prove paternity of course which he has to pay for, unless you refuse to consent to the test, then he can get a court order and you will be responsible for paying for it. He will have to go to court for a custody hearing. He wont get full custody unless he can prove the child is in danger living with you but as long as he meets the criteria yes he can get joint custody. If he can prove that you tried to prevent him from seeing his child or from claiming paternity it could come back very negatively on you. Your best bet if your are positive he is the father then you should file a petition for a custody hearing. This way the courts know you are not trying to deny him his child. A child deserves and needs their father in their life as much as they need their mother.

Why wouldnt you put his name on his child's birth certificate? you made a baby with him.

He can always demand DNA testing to prove paternity.
