I've heard that on 1st January 2007, a ban on smoking will be introduced in England. Can anyone tell me the exact details and what will be my responsibilities as an employer?

As far as I know, the smoking ban comes into force in April 2007. It will mean a complete ban on smoking in public places, restaurants, public houses, cafes, the work place and anywhere else you can think of which is classified as a public space enclosed and indoors.

As an employer you will are responsible for upholding the law on the smoking ban. You do not have to provide smoking facilities for your smokers. You must protect your employees from *** smoke.

Failure to protect your employees from *** smoke, could result in a claim being made against you and/or your company should an employee go down with a smoke related illness and if that person had never smoked and you continued to allow smoking in or near your office.

Here in the U.S. smoking bans have been enacted by various states (California) and in certain cities. It's up to local juridictions and laws to enact or not. They said that a ban on smoking in all restaurants in California would kill business. Well you know what! the ban has been on for ten years and the restaurants are doing more business than ever. All government places have the ban in effect. The smokers argue that it is an infringment on their rights, but common sense has prevailed in that the right to breathe clean air comes before the right to pollute the air.

Depends on your business hun, if it's restaurant or public house, no smoking allowed on the premises, by staff or visitors. It's a good thing in a way, protects people who don't smoke from passive smoking. But it's also taking people's choice away, case of big bro, guess there's no answer. Soon we'll all have our choice of lifestyle taken away, then there will be chaos!

Something was said in a tv discussion today that put a diffrent spin on things.

Imagine an employee taking you to court because you have allowed cigarette breaks for the last 10 years and he's now got Cancer.

I think new laws are the best thing to happen for many years.

Well, it is already here in Scotland. No one can smoke in a public place nor in the workplace. You can be heavily fined if anyone in your employment is found to be smoking.

As a long time smoker I have no objection to the law as long as I can have my fags in peace in my own home!

But please dont start complaining when TAXES lost through less sales are put on things you like!!!

thank god, smoking is bad for your health, expensive, unattractive and it stinks.

But if there are no cigs. what will the goverment tax instead?
