my husband had gotten caught driving with suspended license and he went to jail and i bailed him out and when he went to court they said he had to pay 67.00 a month until like 500.00 or 600.00 dollars was paid, now we are 2 months late on it, what i want to know is if we didn't pay it and they put out a warrant for his arrest, how long will they keep him in jail, he was supposed to have this paid up by april 07, but financially we aren't able to make the payment right now, or once they issue a warrant, can we just get it paid up . i don't know how all of this works if some1 knows please tell me, he got caught in kaufman county in texas

You might want to pay a visit to Legal Aid.

He needs to stay out of jail. And y'all need to make sure you catch up those fines somehow.

Talk to the court that is handling the payments. Usually they will work with you if you are making an honest effort.

I have to say this, and please don't take this the wrong way--your husband sounds like he could stand to do some growing up.

You will find the courts do want money in Texas. Almost anything you do illegal can get you a hefty fine. So it's best not to do anything illegal. I realize that can be hard for a "macho man," and maybe your hubby isn't one of those, but it is best to keep your nose as clean as the proverbial whistle until you can get things resolved.

Good luck and nag him incessantly.

Go to the Courts clerk office before your court date, and explain your hardships of the payments. Most of the time the Court will always work with you over money burdens, unless it is child support. The Court wont play around too long over failed child support payments. Driving while suspended is usually a misdemeanor if the charge hasn't been enhanced (MUTIPLE CHARGES) from prior charges like a prior DUI. If you don't go to court whether you have the money to pay the fines or not the court will call for a warrant without bail, and your case will just get deeper, and deeper. I say you need to ask for a court appointed lawyer to sort out this thing, since your not a lawyer yourself. The courts where I live will tell you to get two jobs to pay the fines if your serious about the crime committed.

They won't issue a bench warrant until April 07 when the fines are due... At that time if the fines are not paid, and a bench warrant is issued and he gets arrested, he will be in jail until arrangements can be made to pay the remaining fines... Sucks but that's how it works...

Ouch... Too bad you all are in Texas, in Cali that is a cite and release. I can't see him doing more than a few weeks, tops! Pay those fines. If not this will continue to happen. Reiterate to your husband "DO NOT DRIVE, you have a suspended DL!"

It amazes me that people continually drive when they know they are suspended. I would say 5% actually have a somewhat decent excuse, ie: getting diapers, etc...But, a majority are just being idiots. And that moment of idiotness will cost a lot of money.

You will have to pay an additional penalty with the actual payments.

you can call your local county court office,the financial dept an set up payment planning,but what ever don't get pulled over again.the cop would see this as a failure to appear an jail him again,or failure to pay.

you need to go to the courts and make arrangements before this gets out of hand...they should gladly make arrangements for you but you need to talk to them before they talk to you...
