Hi, I am Mexican. I am going to Beijing on January 10. My turist visa has expired and I have student visa, but I doubt I can use it because I finished my master's degree in January.
I wonder if I can stay in the airport "In Transit" while I wait for my plain.
I hope someone can help. I need to buy my tickets to China soon

You need a visa to enter the United States even when you will transit into Beijing.

Yes, now you need a transit visa due to the high risk of Mexican terrorists unleashing all hell on U.S. soil. America is so much safer now that these rules have been implemented. Interestingly enough, the following countries are exempt from the rule: Afghanistan, Egypt, Malaysia, Pakistan, Philippines, Saudi Arabia, Somalia, Sudan, United Arab Emirates, and Yemen. I suppose that is fair, though, because the likelihood of terrorist activity stemming from those nations is much less than it is from Mexico. Homeland Security makes our homeland so much more secure!

If you don't have to pass through customs and immigration to get to your Beijing flight, then you don't need the US visa. Airport international terminals are considered international territory, so you don't need a US Visa to hang out there while you wait for your flight.
Have fun in Beijing/China. I spent a summer there and had a great time.

Yes, you'll need a visa as others have said. This has been true since August, 2003. Here is the official reference that others couldn't find:

i have looked to find a article that would assure you a safe transit trough the US going to Beijing , i did not find anything official ,
therefore if i were you ? i would contact your consulat to make sure of you able to stop in the US ;email them ....
better be sure .
you can also call a traveling agency and ask them about your trip and your stopover ,they will know exactly .
i know that you used to could stay in transit ,but so many laws have changed lately .
do you also have the new passport ? check on that too .

yes. go the www.travel.state.gov or www.state.travel.gov there is a new third nation transit law that is now in affect no visa not transit into the usa. +

Are you using a travel agent? He or she should be able to answer this question for you, but yes, I too believe you must have a current visa to pass through the US

i imagine the conception of Heaven is that it is meant to be the perfect position ever. it will be like going from a s***heap B&B/inn that stank of urine and had lots of crackheads round and about, and the position you had to pay extortionist expenses for an nighttime, to the perfect, maximum luxury inn ever, for loose. you does not bypass over some thing about the urine-soaked hellhole. not putting forward Earth is as undesirable as a urine soaked hell hollow lol yet only attempting to rigidity a factor

you will need a transit visa you will have to go thru passport control and ice will be there to stop you cold on your tracks without one
