Technically yes we are still at war with N. Korea. An ARMISTICE AGREEMENT is the only thing we have declared (1953) since the end of the Korean War (technically a cease fire). That is why the military awards the KDSM for duty on the Korean Peninsula, and there is a declared Demilitarized Zone (DMZ).

To answer your question under the legal definition, we are still at war with N. Korea - a declaration of war would not have to be declared. The entire legal definition can be found in my sources.

The Korean conflict ended with a cease-fire agreement between the UN and North Korea and China. It was never a declared war by the UN, US or the remaining allies so it cannot accurately be called a state of war. Although I am sure the soldiers and civlilans caught up in it might of disagreed.
The conflict has been on going but does not involve major armies or battles.

The two are officially in an armistice, and to be more specific that is between the DPRK and United Nations Forces (i.e. the United States and South Korea). The Armistice ended fighting, but is not the same as a peace treaty.

Bush is going to play dirty and talk tough, but I do not think he can afford a third war in his last two years in office, especially with North Korea. That country has the world's fourth largest military, more than a million strong. Worse, it will tick off the Chinese.

the U. S. is obligated to maintain Japan in cases corresponding to this (as a effect of the Treaty of Mutual Cooperation and secure practices) and so we could particularly be compelled to pass to conflict. The particularly significant project this is who ought to improve right into a member of North Korea. rather a pair of people were crying out that North Korea, Russia, and China will band jointly and start up international war 3, even with the indisputable fact that this is the suited component that a minimum of Russia and China prefer, and the two one in all them have in up as much as now years been strongly discouraging North Korea from performing those "missile" exams. Russia and China are not uninteresting. China's ordinary got here upon targets with their individuals of the kinfolk with North Korea is to stay sparkling of them going to conflict (and making their coastline a purpose dangerously virtually North Korea), and to stay sparkling of a crumple of North Korea to stay sparkling of an influx of refugees. Do now no longer overestimate China and Russia's ability over North Korea's selection-making, as they seem to be a fiercely independent, if thoroughly misguided united states of america. i ought to in my opinion now no longer placed it previous North Korea to start a conflict they might now no longer probable win in simple terms in an attempt to create a international military conflict, though I prefer any thought-approximately such an attempt ought to in no way come to fruition, and characteristic been it to realize this, i'm distinctive that Russia and China ought to maximum probable now no longer come to the help of North Korea, if conveniently for the reality that the USA is a extra robust replace better half than North Korea. a minimum of i ought to prefer that the better international powers at contemporary ought to celebrate with that petty alliances are what began the ordinary international conflict.

We've been at war with NorKor for the last fifty-three years....a ceasefire is currently in effect. Why do you think we've got the US 2nd Infantry Division on alert status below the 38th Parallel? For their health, don't make me laugh. We only recently removed (in the 90's) the tactical nukes form the penninsula, to be used to counter the manpower edge of NorKor. But they're in the bullpen, trust me (SLBMs and nearby strategic bombers).

At the moment, no, but it could happen at any time when we least expect it. The UN is all but obsolete anymore. The US kicks butt and takes names and sends everyone over to Iran, Iraq, Afghanistan and leaves the homefront bascially defenseless so anyone with some balls could do some heavy damage over here. It frightens me to think that we could be attacked at any time. Don't think it can't happen because it could.
