i got scammed on ebay and ive been through this big mess trying to find out the guys information address etc well paypal will give it to be but thy keep chainging they needed my lawyer to call so she did then they needed the police to call they did now they say we need a subpoena i was wondering how to get one and does it cost money?Thanks

File a case in small claims court so that it will issue a subpoena to the offender for him to appear regarding the case. A minimal fee will be charged to you for filing the case.

Since you already had a lawyer reach out to Paypal, then that Lawyer could handle the subpoena part, as well.

If the fraud was across state lines file a complaint with the U.S. Attorney for your federal juducial district. THEY will make Paypal jump through hoops and solve the problem or arrest the perpertrator. If it is within the state, your State Attorney General will be interested.

Don't use PayPal.... they suck.

Ebay should have an alternative dispute resolution procedure in place that could help you resolve all of this on your own without having to pay a lawyer or go to court.

I do not think that "you" can request one because this has to come from your attorney.

I am sure the cost of this will included in your attorney's fees.

Speak with her about this. And reearch and know your rights!

If you were scammed it sounds like their have been interstate violations and criminal law has been broken!

Have you contacted the Consumer Affair division of your state's Attorney Generals Office?
