accepted home sale offer on home and signed contract, ive just been informed that i will be going to Iraq verbally, orders not published yet but i will be going, i called the realtor and told them i want out because of it, of course im being threathened with law suit i replied go for it and told them not to contact me that the lawsuit is beteen myself and the buyers not the relator and due to deployemnt the buyer would have to wait 18 mths until my return to sue me i offered to pay the buyer back all expenses after review of the contract i found a loope hole i dont own the home outright rather my mother is the lien holder they have no way to confirm what i actually owe nor did the contract state that the lien holder would release the title even though its in mine and my wifes name my mother has a lien against it and as far as she is concerned i owe big time interest on it and she wont relase the lien, jag also said it would be an uphill battle for the buyer iraq has weight what u think

lien is legit so is deployement to iraq, courts are costly, most brealtors are looking out for themsleves and not the buyer or seller, im willing to poay each the buyer and seller both 1000.00 which is more than what either of them have put out sue me ? really is it worth the time and money? If you would kick a soldiers family out of a home after they were told they were going to iraq and then try in sue, good luck, i have a good reason i was pushed into signing thinking i was PCS ing, the lien is valid either way they have no idea what the lien is and im looking out for my family im not ripping off anyone in this situation

I'm not real sure where you live, but when you put a house on the market they usually do a title search. If they had done the search they would have realized there was a lien on the house and it would not be available to be sold. I would try to get in contact directly with the buyer and explain your situation. I'm sure if they have any compassion they will understand you're circumstances and will work with you to find a way out of this.

I think you have a legally binding contract, you are trying to use your mothers lien fraudulently, and deployment out of the country is not an escape from the contract. What JAG told you was deployment would make suing you for breach of contract nearly impossible. You are still trying to breach a legal contract without legal cause.

you are a lier the buyer will sew you and the lien will be paid at the closing from the sellers check.
