My sister died 6 months ago. And before she died (cancer) she told me she wanted me to take care of Istas. (We only talked about this, never documented.) My sister's husband was a horrible father/husband- he had affairs and emotionally/phsyically hurt my sister and Istas. Unfortunately, my sister never left that man, and he has custody of her. Please note, my niece is 5 years old. I really don't want her living in a bad home and I promised my sister, as well, I love my niece. How can I get custody of Istas?

You will probably have a hard time getting legal custody of your neice, but you should make some kind of truce with this man so that you can remain in your neice's life. He may be perfectly fine with this since the child is going to need a mother figure in her life. Tell him that you had a special bond with your sister and made her promise and ask him to help you keep your word to your sister. Don't go in to talk to him with anger. He is probably grieving also. Remember if your sister stayed with him, then she probably did love him. You need to look deeply into this man to see what she saw and loved in him.

CPS is required to place a child with family when there is an appropriate family member. You will need to get ahold of the worker to beging the homestudy and background process. This can take several months, so I would get started right away. Also, get an attorney. This will expedite the process. Try calling legal services if you cannot afford one. Also, some things to do: When you get the enormous packet of information, get it completely filled out, make a copy for yourself (start a file of all this information) and turn it in within a week. Then superclean your house for the homevisit with the licensing worker. Make sure ALL medicines and chemicals are out of children's reach (behind locked cabinets); display a map of fire exits. Request the worker keep you informed of all Family Support Team meetings and attend all of them. Take notes. You are obviously the better placement, you don't need to badmouth the other options, just point out why you would be the better placement.

Well, I want to start off by saying how sorry I am for your loss. That is a difficult thing to go through. I admire you for keeping your promise to your sister.
I would try to talk to him, your brother-in-law and see if he would be willing to sign guardianship over to you and if not perhaps you could talk to a social worker that might deem it in the childs best interest that she be with you. It's sad that children get affected like they do in scenario's like that. Maybe talk to an attorney who will give you some sound legal advice.

Report them to a child agency whereever this may be. They usaully can check if they are be abused and its the only power that can force things upon them if things are truly going bad. This may take power out of your hands but its really the only way.

You would have to take him to court, but it would be difficult since he is the father.

First off get a lawyer and try to get proof of any abuse or suspected abuse.

you can not. it is not legaly possible. we had a similar problem in our familie, the jerk son of *gun* wound up with my neice. :(
