I work two jobs (one full time and one part time) and with my medical conditions I miss a lot of work per month. Will they garnish both of my paychecks or can they only do one? I have been sending this lawyer checks for $10 - $25 per month what I can honestly afford to pay this debt. I'm also in the process of paying off my bankruptcy lawyer to get the case filed in court (They don't know this). Do you think there is a chance that if I call the lawyer they will work out something with me so my paychecks don't get garnished? My mother did this once with her's and it worked. I'm just worried because I'm going to honestly end up on the streets in about two months if I can't stop it. Any suggestions here please?
I posted this another place and only got two responses. I live in the Kansas City, Missouri area. Is there someone I can call to talk to these guys about making payment arrangements. They refused to take payment's prior to court but I sent money anyway.

The minute you file for bankruptcy, the court puts a "stay" on the judgement, which means they can no longer collect on it. It will prevent them from starting garnishments.

So how long before you can file for bankruptcy?

They key work is "stall"! Hold off this guy until you can file your BK. If he does decide to garnish, read up on the procedure to fight it. For example, in Michigan you have 15 days to file an appeal. Then they have to setup a court hearing. You may be able to delay that with some excuse about illness or being out of town. In all, you could buy 4-6 weeks of time, maybe more.

Unfortunately with the new bankruptcy laws, probably only a legit credit counselor could advise you properly.

i think as long as you're making an honest effort to pay them you will be ok but it depends on how long over due the account is.
