I have not seen payment on child support . can the court take visitation right away ,until he makes, payment or it does not matter if he pays or not he can continue to see his kid without the responsabilily. what can i do? please help

Visitation cannot be taken away for this reason, at least in Illinois. If he were a man, he'd be taking care of his children. Enforce the laws and take him back to court on this. If you have to holdd him accountable, then so be it. The kids deserve it.

child support is not usually dependent on visitation or vise versa. That being said - there are things you can do to get your money - if necessary, a court order can be made which will have the child support removed form his paycheque automatically so that you get your money.

On a more personal level - don't use visitation as a means to get money. While you are not doing it to hurt the child, the child will not understand that. Your child should never be used as a tool or "brbde" when it comes to dealing with the other parent - for child support or any other reason. Children need stability - for the child's sake, look for legal means to get your money without disrupting your child's life any more then absolutely necessary.

No. Visitation is about the rights of the child to know both parents. This is the CHILDS right. You can not use said child as a weapon. Child support is a totally seperate issue. Go back to court and have the support enforced.

Well, unfortunately that is not the way it works. What happens when he does not pay his child support, they send him a bunch of letters, when that does not work, they suspend his drivers license. He has to pay his back child support to get them re instated. Then finally, the last resort is to put them in jail for contempt of an court order and their bail is set at the child support arrears.
When they were making these rules, they forgot to get input from us mothers who work hard to support our children. When I complained about it, they told me to write or contact my congressman.
I do realize that there are some situations where some mothers would gladly give up the child support (since they never receive it anyway) to keep the fathers away. It is not only difficult on us moms, but it is torture for our kids.

The judge in family court can make the determination on collect child support. He can order payments, institue fines, garnish wages, even let him cool his heels in jail for a few days. But child suuport is not usually tied in any way to visitation rights.

It's really not in the child's best interest to be denied visitation from his/her parent, even if the parent is not paying child support. The issue of child support should be handled separately from visitation. If a parent is not paying child support that you are supposed to receive, contact your local department of human services, or whatever social services dept. in your location it is that handles child support enforcement. They will help you obtain the child support.

To all separated parents of children: Do your best at all times not to involve children in your relationship problems, and do not use children as bargaining chips to get the other partner to cooperate with you, even if you are in the right. Children are not able to understand or cope well with adult problems. Moreover, you will be teaching your children to solve problems by being argumentative and manipulating as they get older, which helps nobody.

To deny court ordered visitation is just as much outside the law as him not making relief payments. So...if the terms are court ordered, no. Both sides must abide by the courts rulings.

NO, he is still the father and a child has a right to see his father. you would have to go back to court to get full custody no visitation and it would have to be more than because he's not paying. It's not what's best for you it's what's best for the child. People forget that.

Nope, he is not paying for the right to see his own child. If you want to start seeing payments stop making it so difficult for him to connect with his child. Damn to women who hold kids hostage for money. Children are not pawns or processions and are only half yours I don't care who is paying the bills. It is a struggle for a wife and husband to financially make ends meet why would you think it should be easy for a divorced/unwed mother?
