Don't listen to the people telling you to go to Mexico and get married. It takes YEARS to get a spousal visa. Unless you are willing to wait that long to be with your husband again then you need to get married here. My husband had to pay a fine and then fill out all the applications. We downloaded them right off of the INS website and did them ourselves. He got his work permit right away but it took over 2 years for the greencard. He could not leave the country during that time.

I'm not sure but since they married a legal US citizen it makes them legal. That is why many immigrants do marriages of convenience it gives them quick legal citizenship without having to put in the work for the naturalization process.

File the marriage license! Then, go to the INS and request the proper paperwork to get them a VISA. Then, continue with the steps..... It's really that simple. The illegal may have to pay a fine, I'm not really sure about that.

Make sure they are TRULY in love and it is not interest, get a good lawyer, they are very expensive usually. Make sure that that person has no problems with the law (other than being illegal, lol). And cooperate and pray.

hypothetically they would have to break a couple federal laws, risk being jailed, labled as a traitor to the USA for helping an invader, and then get fake work papers for them. But like you said, its just hypothetical, and I would keep it that way. If you are trying to do so, I hope you get caught. And you will be a traitor to your country.
