360, what do you mean by getting into more trouble? Do you mean if it's a fight at school the person who throws the first punch will get punished?
If you mean by that, then yes. Who ever throws the first punch will get into more trouble as they had initiated the fight and pretty much "started it". However, the person who didn't throw the first punch will still get into trouble if he fights back, if he doesn't then he will walk away unpunished.
The same goes for kicking or smacking, they are both forms of violence & are not necessarily tolerated.

yes its the same. not only that but if someone punches you and runs and you chase them and beat their butt.they will charge you with assult because you become the assailant. even though they hit you first.
