The UCMJ and federal statutes define what crimes are felonies, and what crimes are misdemeanors.

It's not a just matter of the length of the sentence. It's how the crime is defined. Just because most misdemeanors don't allow sentences longer than one year doesn't automatically make any short sentence a non-felony.
