Yes. He can fight the custody of the Mother. He will have to have proof that she is unfit and that he would better manage the child(s) live(s) before any judge would ever take custody from the Mother and give to him, though. If he feels his child is in immediate danger...There is something called Temporary Emergency Custody. Consult a lawyer before any action is made, though. If the Father does anything on the wrong side of the law, it would take away from his chances of winning custody.

He can, but you left out for what reason is he taking her to court? If it is for custody-good luck, cause unless she is abusive or neglectful, you won't get custody.
