Most divorce documents these days address the issue of claiming the children. Whom is the custodial parent? Just paying child support does not mean that you automatically get to claim them.

Current tax law gives the child to the custodial parent, period. In joint custody you have to determine who had the kid the most days. In reality however, either parent can claim the child as long as the custodial parent signs a form agreeing to let the non custodial claim the kid. Only if parents cannot agree does the rule re: the custodial parent come into play.
