I am 18yrs and a college student and my dad pays child support he says that the only way to get me off is emancipation Hes paid child support since I was 10 and I have been spending time over his house and he feels that if I am going to be over there he should not have to pay do what is emancipation? Is he wrong?

freeing someone from the control of another; especially a parent's relinquishing authority and control over a minor child. In my opiniion he is seriously mistaken. Spending time with your dad is important but it is not going to pay your way through college. (if u plan on going)

He is paying because you are still in school. Otherwise, it would have stopped when you turned 18.
Emancipation is when you as the child file for it through the courts, stating that you can support yourself. This is typically done when the child is 17 or younger. But he may also still be paying because he owes back support. I dont think your situation would call for an emancipation because of your age. Besides, if hes only been paying since you were 10, who paid before that? Just spending time at his house does not mean he doesnt have to pay anymore. Sounds like hes just trying to make it as easy as possible for himself.

Emancipation occurs when a person in no longer legally considered a child. The rules vary by state and can also be set by a judge. when emancipation occurs either though existing statute or by court order, the parents are no longer held financially accountable for support their children.

He should have to pay until you reach the age of emancipation, which usually is later on for a college student. If he is not the custodial guardian and lets you stay at his place he does have the right to request financial compensation from you but this does not free him from his legal obligations to pay child support.

Emancipation, as far as I know has only ever been used for a child to divorce parents. Especially parents that may be exploiting a minors trust fund, inheritance something like that. I do not believe the law was made for deadbeat dads to wiggle out of child support.

it has something to do with you taking care of yourself as an adult on your own even if you not 21years old. i feel your father should take care of you as long as you are still in school and under 21 years of age.your are still HIS responsibility til then..if you are emancipated, then he dont thave to pay child support, you be taking care of yourself on your own til you are legally 21. i think he is wrong for suggesting you that.

its a legal procedure...guess what Youre wrong He can ask for room and board since youre an adult
