i was parked in front of a restaurant getting a to -go order because the restaurant parking lot was full and i came out and a man told me that this woman hit my car (92 buick lesbare). She stayed in place while i call the police when he arrived we exchanged insurance information which i have liability i dont know what she has but the police told us he could give us a police report because it was on private property which was at the restaurant. So i know she gonna have to pay for me a door panel but how do i get the money and pocket it instead of getting it fix because its an older model vehicle even if i did had it fixed it would have to get painted and that would look old for my car. So i would rather pocket the money so how do i just get her insurance agency to cut me a check

The dent was minor but noticable. I dont consider this as fraud because if i go to sell the car they are going to want me to take some money off the car because of the dent.And i more than likely it probably dont need to be painted i dont thinks its that bad but i do have a dent my door. How the flick do you hit a parked car?

A suggestion....don't tell them you want to pocket the money.

Actually, as a third party, you do not have to get your car fixed, and can get a check payable to you. The only person that the insurance company is required to make sure gets the car fixed is their insured(when he has a lien holder). Issues about this could vary by state, but they only have to pay for the repairs. You may butt up against a stubborn carrier who insists on making the check co-payable to you and the shop. Be ready for that.

Some insurance companies will send the check directly to the body shop, some directly to the customer (you). Your best bet is to contact her insurance company and request that the check be sent to you. The reason you give them is not that you don't want to fix the car (if you tell them that, they can argue that they shouldn't have to pay you since you aren't fixing it), but that you don't know when you would be able to let go of the car long enough to get it fixed.

Get an estimate from any body shop. If you think it's a reasonable amount, send her a bill for that amount. She should then pay you and ask her insurance for reimbursement. You can do whatever you please with the money, but her insurance can ask you to sign off on it, and if they do you should.

You need to go to a body shop and get a quote for the damages for your car (even if you are not goin to get it fixed). Then you need to call up the insurance company and send the quote to them. They will cut the check and it will be made payable to the body shop...not to you. What you are trying to do is insurance fraud and it is illegal.
