My fiancee was invloved in an accident where the fault was clearly a Geico customer's fault. I have nothing against geico and I'm sure they have low rates but her car was totaled and the police report specified that it was the other drivers fault. We need money to buy a new car and it is seemingly impossible to get them to cough it up without getting involved in an expensive lawsuit or signing a paper that puts the fault partially on my fiancee. We even have a witness that verifies the liability of the other party but our lawyer says that it doesnt matter unless we go to court. does anyone have any advice?

Good luck with that. I'd threaten a lawsuit immediately if they aren't forthcoming with the $$$. Gieco advertises all these wonderful low rates. There are two ways they can afford to do that: 1) They fight every penny on every claim and 2) when you have an accident, or get a ticket, they either drop you, or make your premiums so high that you leave. That way, the only people that stick w/ them are those that never get in accidents or even get tickets.

If the police report specifies that it was the other party's fault, then that is prima facie evidence.

Your lawyer must be a limp SOB.

You should sue for complete compensation including lawyers fees.

And maybe you need a new lawyer.

yes go to court, don't let geico push you around they are a tricky company and i don't think they are trustworthy. a friend of mine has them and they are quite the opposite of thier commercial where they say they pay quick.... but don't be led astray take it to court till you get justice.. if your lawyer is too expensive.. try getting joe bornstein or something.. good luck

If you have an attorney you need to leave the advice seeking to him. Plus, you did not say enough about what happened or what delays, etc. you have encountered for anyone to give you advice anyway.

Wont your insurance pay the claim then go after the geico company?

GO TO COURT.......if you can prove your case, they will have to pay your attorney's fees also, so won't cost you a penny.
Call around, and you can find an attorney who will represent you, and not charge you unless he wins your case
