The leak is from the roof. The landlord says he is waiting to fix it. My boyfriend can lay dry wall, but that would be pointless until he fixes the leak. He does not really want us to paint the walls anything other than white, but he himself is only going to paint over things that are messed up. I love the apt, but it needs work. We are willing to do it, but we'll want him to pay or for him to take money off of the rent. We have not signed our lease yet and we've only paid him half. We are moving in on thursday, we have be out of our old apt Saturday. The landlord himself rushed us moving in and giving our old landlord notice.

I would get something in writing from the landlord before moving in. That way, he can't sit on it too long. You do have the upperhand here in that he is legally obligated to fix leaks or any other type of problem like this that arises. You also have the right to withhold a certain amount of the rent until this is taken care of. Though you do need to contact your state to make sure how to go about that. I do believe you need to give him sufficient notice in writing to take care of the problem. If you are looking for reimbursement without his signed agreement, you have no right to expect that and he would not have to legally reimburse you unless you made that agreement with him in writing. As far as painting over the stains yourself, I would leave it until the leak is fixed, or you are just going to be painting it again. And just on a personal note, I would be VERY CAUTIOUS of a NEW landlord who is not taking care of repair issues BEFORE you even move in. Regardless of how much you love the apartment, this is a sure sign of how he handles things. I would take this into consideration for future problems that may arise. Do you really want to be going through all these hassles on a continual basis every time a repair is needed??

Despite all the legal ramifications, a temporary fix might work if the ceiling/wall is just stained. Take a spray bottle, mix 50% water and 50% chlorine bleach with 2-3 drops of dish-washing detergent. Wear a mask over nose and mouth and spray stains. Be sure to cover anything that might get stained by the bleach. Repeat several times. This may help, but nothing is permanent until the leak is fixed.

I wouldn't do anything until he fixes the roof leak. You may need it the way it is for proof in case he doesn't bother getting around to it. If you take legal action to get it fixed you will need for the court to see the problem.I think I would be really careful with this one. He should have fixed it first & NOT rushed you about moving out of your old appt.. Something stinks about this whole deal.

well you said he's only allow white paint' get some kils stain and it will hide the stains til something is done. your landlord is suppose to take care of any problems dealing with his rental house, keep on him!! fix that roof. winter is approaching..

it should be fixed as a part of your lease because of black mold concerns,but if not then cover the stained areas with aluminum paint and then repaint your choice of colour and hand the bill to your landlord
