my fiancee is a habitual offender with a suspened license which means he cant get registration or a tag and that is the main reason why he gets pulled over and thrown in jail cuz they see his expired tag...I am thinking about putting it in my name, then we will switch it over when he is able to get his license back which is in a year. I am sick of him going to jail and i cant keep affording to bail him out with 2 kids plus its a pain to do.(we can be saving that money and paying all his court costs off)plus if he ever gets pulled over again, the car will be mine, not just put in a tow yard. the thing is if he gets pulled over for something else like running a light and they find out he is driving in with a suspended license...will i get in trouble cuz the car is under my name and he is driving it? he has to drive , he owns his own business and he needs to support the kids and me.

First, I would tell him that he is no longer driving anywhere and to give up his license. Second, I would go out and put the registration and insurance in my name before anything else. After that, if he is caught driving the car again, the car will not only end up in the police impound yard but you will be responsible for paying the money to get your vehicle out of there not to mention getting your fiance out of jail, once again. Once you bail him out, remind him that he is not to drive under any circumstances. Ultimatums will only make things worse, so steer clear of those. Remember most of all, you have two children together, right? They need him as much as they need you.

I agree thatyou could be saving money instead of wasting it on his behind but still if he isn't going to listen, maybe he should have his license revoked so when he gets into trouble again, he won't have a license to present to the police.

I have had this happen to me and the police called me to come get the vehicle so it would not end up in the impound lot. Also too, anything that is valuable to you that is in that vehicle at the time it gets impounded will become the property of the police department and let me tell you, the police don't care if it is something for your children, they will confiscate it and never tell you.

First question I have is, why are you with this loser? But that's another issue. The legal issue you are concerned about are valid. If you allow someone you know to be driving without a license in a car you own and insure, you could lose your insurance. If he uses the car that is in your name (you own it) for an illegal act, you could lose the car and possibly be arrested as an accomplice. If he needs to get to work and he's supporting you and the kids, you can drive him to and from work and leave the car and all it's associated problems in his name.

My personal recommendation is to get a job and leave the guy for someone else that doesn't have his legal baggage.

It's illegal for him to drive with a suspended license. Nothing you do is going to make that go away. He needs to figure out a way to make a living without driving. Instead of trying to find ways to circumvent the law, you need to figure out how to live within it. I'm not sure what makes you think he's going to end up getting his license back with all those repeat arrests, or why you feel comfortable with him driving considering his complete disregard for the rules of the road.

The bigger issue is why you're with the guy, but I guess that should be on the relationship board. Quit bailing him out and see what happens. If you have to pay his bail money all the time, how is he supporting you and the kids?

Your insurance will skyrocket if they find out.

Yes, you can get into trouble for allowing an unlicensed (or suspended) person drive your car.

Kim, the answer to your question has to come your insurance agent, because different companies have different rules. Some companies have very strict rules, who ever the car is titled to has to have the insurance in their name. You can add your father on the title along with you, and that will solve that problem. Then some companies, it doesn't matter who's own the car, as long as they are living under the same roof. To make sure you don't run into any problems, call the agent, and they will be glad to tell you whether the title also should include your Dad. Congratulations on the new car, and please be careful! Bigger problem here. Why can't he learn his lesson. Oh, you have kids too. What kind of lesson are they learning? You are headed for some serious problems with this guy. But what do I know right.
