Yes, I think so. Good Idea. They should not be here anyway. I know plenty of illegal immigrants from different countries, who are using other peoples social security numbers and they live a hell of alot better than I do. They drive fancier cars have beautiful homes, with beautiful furniture, etc. Why should they? I was born here. Take it all away.

I'd hate to see anyone lose their property! Although they came her as illegal aliens, they have worked hard to get what they do.
Although I think something needs to be addressed with this issue. Like the ER filled with immigrants etc. NY would sink without them. The kids here are to snotty to work in grocery stores or clean a room. We'd have nothing being run because employers have a hard time finding people to work in lower level paying jobs.
I'm not saying it's right to allow illegal aliens into the country to work and do whatever they please. But, taking their houses away isn't going to change anything.

No. That would be a violation of the 5th Amendment -- a taking of property without due process. By your logic, anyone who commits any crime could lose any or all of their property. Speed and lose your house? Cheat on your taxes and lose your dining room table?

Forfeiture laws require that the property itself is "guilty" of a crime-- either it is (a) contraband (i.e. illegal to possess) (b) a piece of property that facilitated the crime, or (c) material proceeds traceable to the crime. Courts have long recognized that these three categories make the property forfeit, and, after notice and a hearing, there is no due process violation if they are turned over to the government.

So, let's say an illegal uses his own truck to cross the border. The truck could be forfeitted as a piece of property facilitating or aiding in the crime. Let's say that a guy "smuggles" aliens in the basement of his home to hide them from the police. Technically, that home could be subject to forfeiture (because secreting away illegal aliens is a crime). Let's say someone uses a fake passport to get into the country. That passport is forfeit. Let's say someone makes $1000 a head smuggling people into the country. That money is forfeit. But it would be a big stretch to say that illegals' property, just because it was acquired here, is forfeittable.

Once they have been apprehended and deported, their land if its theirs legally (?), should be used for legal people needing shelter, or used by some charity organization. The law does not specify that their property can be seized, unless they can "prove" that is was paid for using illicit funds.

yes-
Auction off their belongings and use the $ to pay for their immigration lawyers they are going to need for the deportation proceedings.
I believe they chose to be exploited when they entered this country illegally.
