Call a lawyer, but I'll bet you're going to have a hard time winning.
Airbags are designed to deploy only when certain things are present and if any one of those things aren't present then the airbags won't deploy.
You said you hit the concrete wall head on, how fast, head on at an angle? Did you modify the car in anyway? And remember airbags are only supplemental only not primary so you were wearing a seat belt right?
And even if you get a lawyer and s/he agrees to take it on contingency you are responsible for all expenses.

The air bag system would have to be proved defective to assure your success.
This is unlikely because the system goes through a complete check of the critical components each time the key is cycled on - any concerns and the air bag warning light will activate and stay illuminated. This is why the light stays on for a few extra seconds before going out after the car is started.
The deployment of the air bags is not based on when you think they should or shouldn't have deployed, they are activated by crash sensors.
A minimum of two sensors have to be activated in most vehicles to deploy the air bag system. These are inertia switches that are held open magnetically - if the crash is sufficient to dislodge the contacts, the air bags will deploy.
If you wish to pursue a lawsuit, the details of the accident - speed, steering motion, braking, and numerous other factors prior to and during the actual collision may be retrieved from the cars on board computer.
You should, at a minimum, contact a lawyer and discuss your case with him/her.

Newer car, as in used but not "old"?? It might be one of those cars that were in a prior accident and never got the air bags replaced after deployment. There was a special consumer report about it.

Go to a local law office you'll have to pay a retainer and if you win at least a 1/3 goes to the lawyers. First I would check with a mechanic to see if the airbags were deactivated or were never activated.

Was your check engine/service engine soon light on? Was your cruise control functional? How about the horn, was it functional? If you answer yes, no, no, most likely your clockspring was out, and it's your problem because you didn't get it repaired. I also have to wonder how on earth you didn't see a concrete wall, and hit it head on. Sounds a little fishy to me, almost like you're trying to run an insurance scam.

You need to contact your state's consumer protection agency, and they do an investigation. If they determine the manufacturer was at fault, you may have grounds for a lawsuit
