The flag can be flown at half mast if someone dies. It shouldn't be a problem.

Ordinarily, the flag at the VA Hospital is flown at half-mast during the first half of Memorial Day (prior to noon) or when designated by the President. Same with the military hospital, though the base commander can also designate when a flag can fly at half-mast.
If someone "just flew it at half-mast", they would be certainly be questioned as to why.

No..techinally...You could fly the flag at half-mast all the time if you wanted too. But, the Flag code a set of guidelines prohibits such action. You will not get arrested, but maybe questioned as to why and told to fix it.
According to the flag code only the President or a State Governor can warrant the flag to be flown at half-mast

flying the US flag at half-mast or half staff is a sign of mourning or loss. It is usually reserved for the death of statesmen, but lately, it is used for just about any death, in the name of political correctness. When the event warrants it, and the charge of the colors orders it, then fly the banner as instructed. To do otherwise shows a severe lack of respect for the flag and all it stands for.
