no you cannot sell something you do not own

Sure he can. He is selling you a vehicle which you can never get license on and drive on the road, but he can sell it to you for parts. That is true in all states. If you plan to drive it, you need a clear title. Even as a parts car, I would want to run the VIN through the local police to make sure it isn't listed as stolen.
