me and my wife are separated for about 5 months now since then she has found a partner which i no nothing nothing about there are babys involed and it concern me because she won't tell me anything about him other then being from another town and that his is jim and been in the state system twice my question is can i take them if she isn't concern about our children why should i be concern about hers

Every state is different. If you are legally seperated and have a custody agreement, you certainly should be able to petition the court to say she is consorting with a known criminal and you fear for the children's safety.

If you don't have something legally binding in your custody arrangement, I think you are on thinner ice, frankly. When you say "just take the kids", you leave yourself open for child snatching charges, etc. and must be careful not to traumatize the children "for their own good".

Certainly as the father you have some rights. You could talk to Child Protective Services in your county or you could talk to the family court system and find out where you stand legally. Talking to a lawyer might be a good idea too.

Remember that every state is different, so some advice you get here might not be valid in your location.

I'm not sure I understand... your ex will not tell you about her new man so you're concerned about your kids? If that's the case, you probably can't 'take' them from her. In a courtroom, it'll pretty much just be dismissed as the mother's right to not tell you about her personal life if you're separated.... BUT, morally, your ex should have enough respect for you to let you in on who is around your kids.

if you are concerned about you kids you can get the cops go with you to get them.since you are still married you have ever right to be worried, she evidently doesn't care or she wouldn't have her kids in the middle of this
