you could try to apply for status as a refugee, but there are many criteria, and you need the advice of a professional

Unless you have paperwork showing you have full custody they are going to ask you for a letter from the other parent approving taking the kid out of the country. Either way that paperwork is going to be on file and really obvious if you don't return with him.
