Yes, this would be a felony if the services were greater than the felony amount which is anwhere between $200 and $2000 depending on the jurisdiction. If you blew past the toll gates hundreds of times, you could be arrested (which is exactly what happened to one truck driver who never paid his tolls)

I received a bill in the mail from the New Jersey Port Authority once when I was going over the George Washington bridge. I paid the toll guy, but apparently they didn't believe me. Rather stuipid to assume that I would stop for the toll guy and then drive through without paying when I could easily have just driven through the ezpass lane.

From this personal experience, you will most likely get the bill in 45-60 days, which is retarded because they give you 30 days to appeal and it will be way past this time. You will also recieve your bill after a late charge has been added (chief reason why I never paid mine). Your best and most honest course of action would be to contact ez pass directly with all of your information and make arangements to pay now.

A judge has better things to do than to issue a bench warrant for theft of services, amount in controversy less than $20. If I was arrested for something like that, I would sue the arresting police officer for false imprisonment and a section 1983 tort claim, and the toll authority for abuse of process.

I would recommend getting a sticker, you will save yourself hundreds in tolls with only the added headache of mistaken billing.

It's not theft if you pay later,
the case that comes to mind from the 1940s was of four individuals who left a hotel without paying but came back the next day, paid, but were then arrested. The justices dismissed the case on appeal.

In around 2 weeks. Each ticket is only aroudn 20-30 dollars though.

Expect your summons within 5 to 7 days.

Pay it promptly or the Court WILL issue a Bench Warrant for your arrest. This falls under "THEFT OF SERVICES" and can be viewed as a FELONY arrest.
