There is a two lane road one going one direction, the other going in another direction. I was pulling into the gas station, so i putted onmy blinker and stop. Because I had to wait for the traffic to clear so i can get into the gas station. There was a truck behind me and was in a little bit of a rush, so he decided to go around me , over the little white line. i didnt see him over there and plus he wasnt suppose to be over there. i than realize and changed my mind that i really dont need gas right now. when i took off my blinker off and proceeded to go straight. our trucks met. if i didnt have inspection on my truck. Could i still sue that person for there wrong doing and for me having pain in my neck and back.

To be honest, it sounds like this accident was your fault. You were stopped with your signal on, and then you turned into another vehicle. I don't know where you live, but in NJ it is legal to pass a car on the right if they are stopped to make a left turn. So, in my opinion it would be a very bad idea to try and sue the guy.

Yes, in Tennessee that would be reckless driving on the other persons part.

In America, you can sue anybody for anything....

BUT...Collecting and winning the suit is a different story.

Anyone can sue anyone for any reason it happens every day.
