If he was deport, you need to visit him. He can't return unless allowed by law.

As YakRider stated, you could apply for the fiance visa, although the initial application will be denied once at the Embassy/Consulate stage. At that point you would have to file a I-601 waiver to show extreme hardship. In a case like this, where there is a deportation, you'd be best served to hire a lawyer.

To get a visa from mexico the applicant needs to show.

proof he works in mexico , bank accounts. if he own lands he has to show proof. basically the embassy wants proof the applicant will go back to mexico because he has to and not stay pass his visa time in USA. thats why so many ppl are passing illegally because its hard to show proof and many dont have bank accounts or have well to do jobs. Its actually a pain and takes months to do. THat is just for mexican citizens who have never been to usa. I Would imagine for a deported person it would be difficult. contact a lawyer or office of immigration.

Absolutely not. You could not do anything for an illegal alien even if you were a US citizen & married to him. He has no choice but to return to his country of citizenship. He will be barred from reentry. As a temporary visa holder, you cannot even get him a dependent visa because he is in the US illegally and you are not married. If he lives with you, or you do anything to aid or abet his entering and/or remaining in violation of immigration laws and/or visa regulations, you are subject to 10 years in prison plus $250,000 fine. You would lose your H1-b and upon deportation, be permanently barred from reentry to the US. Don't even allow him in your car. Laws prohibiting harboring, sheltering, transporting, etc, are very strict. Either he goes home alone immediately, or you give up the H1-b and go home with him.

Was his deportation to Mexico voluntary or involuntary?

If it was involuntary the odds are he's going to be banned from the United States for 10 years.

If it was voluntary you can agree to marry him and petition him as your fiancee. It will take about 6 months for him to get a visa. He has to get married to you within 90 days of his arrival in the United States.
