I'm going through insurance but I feel pressured to have my insurance fix my car. I have two witnesses that say she ran a red light and she only has the other person that was in her car. Her insurance company is conducting their own "investigation." But that's been going on for four days. Last I talked to them they said they would not accept liability for my car because she is adamently denying she ran a red light. Also, my friends are telling me that my insurance company should not have told me to call her insurance and that I shouldn't even be talking to her insurance company. Is that true? I'm lost and clueless. I've never been in an accident before! Any help would be amazing.

Since FL is a "no fault" state, this is legal. Regardless of my witnesses.

Well first of all, police not citing anyone does not fly with me.........someone is at fault, did the police fill out a police report?? Did you get a copy?? if not, you are lawfully entitled to one. Sounds to me like that you need to get you an attorney, take your witnesses to him and discuss the accident only to him. He will contact the other person's insurance and let them know that he is handling your case. You do not talk to the other insurance company for any reason. You only communicate with your insurance company. Let the evidence of the accident speak for itself, It wouldnt hurt if you went to the intersection and took pictures for your attorney, but ask him first. If any court action is needed, your attorney will advise you of any action that needs to be taken.

Was there a police report? If you have a police report then it will go to a police investigation and the verdict will be unbiased and undisputable.
Talk to your agent. See if you can have your car fixed by your insurance and have the two companies duke it out for the money. In all honesty, you need a car that keeps up with you and your needs. If not, get a rental, save the receipts and submit them to the other company weekly.
Call your agent daily for updates on the case. Tell them that you pay a lot of money (I know I do!) for the services they provide, so they should start earning it.

Looks like your going to need a lawyer. It's a shame that people pay for car insurance, but the insurance companies hardly ever do their job. Hope your problem gets solved.

You insurance company should be working it out with hers. If you are both denyinf fault, then most likely it will end up in court. Were the police called to the scene? They would have filled out a report. What did their report say?

You forgot to tell us the most important thing.
Were the police called, did they do an accident investigation, and did the other party receive a citation that says she was at falult?
Without the cops citing her, you should probably just have your insurance repair your car.

it took month before my insurance settled with the other insurance.... be patient, and let your insurance handle it..... talk to them and ask if you should get a lawyer.... it takes time and you may have to go to court. of course she will deny do you have independant witnesses or just people that were with you cause it makes a huge difference. Good luck.

First of all, who got the ticket for the accident? That's normally who's responsible. I know it seems like it's been an eternity, but 4 days when dealing with stuff like this is a short time. Just why did your insurance company tell you to call hers? That's THEIR job to deal with this for you. That's what we all pay those neverending payments for.

There should have been a ticket issued if the witnesses all said she ran the light. Another example of lazy policework. Call your insurance agent and see what they say, if they aren't helpful call a lawyer and see what they say.

US? You may have to sue for all costs. In the UK the unsurance companies employ their own lawyers to recover their and your costs in cases like this. I was hit by a stolen car running a red light with six cop cars chasing him, it took nearly two years to sort out.

Your friends are right do not call her ins co get you a lawyer an let him take care where she will have to payfor your lawyer your lawyer will take it to court make sure your wwitnesses are in court her ins is protecting there clinet you need a lawery to protect your rights to
