She has been with the guy for almost 12 years, and they have 2 children together....but they are not married. They have a few things that are in both of their names (house, and 2 cars) he has been cheating for a long time and he will admit to a relationship with someone else, but will not admit to sleeping with her. This friend of mine wants to get out of the relationship, but she dosent know what the legal ramifications may be to get the job done....Can anyone help?

hmm...first it depends alot on location, as in what state the couple lives in. Im in Mississippi, I have to admit the domestic laws here are extremely different than many other states. He wants to consider these things or at least find out what they laws are in his state pertaining to these issues:

1. Infidelity (this shouldn't be an issue since they are not married; however; you never know how it will come into play when it comes to her emotions....believe me, women can get EXTREMELY hurt and lash out big time) Know that she will all of a sudden become an expert on the domestic laws and her rights.
2. Separate Maintenance (basicall dividing the "stuff")
3. Child custody and support (is there a law on children having or not having an election, this of course comes into play if he actually WANTS visitation with the children...and the childrens ages are important here too)

Im a legal secretary, not by any means an attorney...just a few things to think about though. It's not pretty...never is....no marriage should be a big factor in his favor though.... Those children feel the hit the hardest. Depending on if they are living together..and how long if so...these things will be basically the most important aspects of any separtation action.

oh, im sorry, i thought your friend was the "guy" in the relationship. OK, so its the girl??? well, she should get an agressive attorney.....no bullshit...and protect herself and most importantly the children by making sure their best interest is met ultimately, including child support, custody, visitation....and then she should lookout for herself - he's a jerk for sure.

Her best bet is to know the legal laws in her state on property.

She best see an attorney. He'll advise her of what is legally her's. You'd think if the bf was a cheat, she could have him thrown from the house.

well she can take him to court,and file for custody of the kids and move on with her loife she don't desever to be treated like that.but if he cheated on her it's something that she is n't doing right.just tell her to sit down and talk to him,or she can write him a letter and tell hin that she want out of that relationship because she can't deal with him no more.
